Terms of Service

1. About these terms

These terms govern your use of this website and any services provided by Exp-Arc Limited (company no. 16980239). By using the site or engaging our services you agree to them.

2. Our services

We provide architectural drawings and planning support. We are not builders and do not carry out construction. Drawings are prepared to support planning and building control, but we cannot guarantee the outcome of any third-party decision, including a local authority determination.

3. Quotes and packages

Fixed-package prices are based on the information you provide. If the scope changes materially, we will agree any revised price with you before continuing. Payment terms will be set out in your individual engagement.

4. Your responsibilities

You agree to provide accurate information about your property and project, and to obtain any permissions required from third parties (for example, freeholders or neighbours) where relevant.

5. Intellectual property

Drawings we produce for you may be used for your stated project. The content and design of this website remain our property or that of our licensors.

6. Liability

Nothing in these terms excludes liability that cannot be excluded by law. Subject to that, our liability in connection with our services is limited to the fees paid for the relevant work.

7. Governing law

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.

Refund guarantee

If a planning application that we have prepared and submitted on your behalf is refused by the local planning authority, we will refund our fee in full within 5 working days of the decision notice, on the following basis:

  • The guarantee covers our own fees only. Local authority application fees, and any third-party costs such as structural engineering or a measured survey, are paid to those parties and are not refundable by us.
  • It applies where we prepared the drawings and managed the submission. It does not apply to applications submitted by you or by another party, or to drawings altered after we issued them.
  • It does not apply where a refusal follows from information that was inaccurate or withheld, or where instructions were given against our written advice.
  • It applies to the planning decision itself. It does not cover consequential losses, delay, or the outcome of any appeal.
  • You may ask us instead to revise and resubmit at no further charge, which most clients prefer.

Nothing in this guarantee affects your statutory rights as a consumer under the Consumer Rights Act 2015.
